What If I Receive a Letter Saying I Am Not Eligible for the DD Waiver?

What to Do If You’re Denied DD Waiver Eligibility in New Mexico

Learn what steps to take if you receive a ‘No Match’ letter denying DD Waiver eligibility, including requesting a review or Fair Hearing.

Understanding the “No Match” Letter

If you apply for the Developmental Disabilities (DD) Waiver in New Mexico and receive a “No Match” letter, it means your application did not meet the eligibility criteria. This decision prevents your name from being placed on the DD Waiver Wait List.

However, you have options to challenge the decision and request a review or appeal.

Steps to Take If You Are Denied Eligibility

If you receive a denial letter, you may:

1. Contact Your Pre-Service Specialist for More Information

  • A Pre-Service Specialist can clarify why your application was denied.
  • They can inform you if additional documentation may help your case.

2. Request an Agency Review Conference

  • You can request a review conference with a Pre-Service Manager.
  • This in-depth conversation allows you to discuss the denial and provide any missing information.
  • How to Request: Call or submit a written request for a review.

3. Request a Fair Hearing

  • A Fair Hearing is a formal evidentiary hearing before an Administrative Law Judge.
  • You must request a hearing within 90 days from the date of your denial letter.
  • This is your legal right to challenge the decision and present supporting evidence.

How to Request a Fair Hearing

To request a Fair Hearing, you must:

Submit a request in writing (letter, email, or fax) OR
Call DDSD’s Pre-Service Intake Bureau to start the process.

📌 Important:

  • You must submit your appeal within 90 days of receiving your No Match letter.
  • Keep copies of your denial letter and all supporting documents.

During the hearing, you may:

  • Present new medical or educational records that support eligibility.
  • Have a legal representative or advocate present your case.
  • Request witness testimony from doctors, therapists, or specialists.

If the Administrative Law Judge overturns the denial, you will be placed on the DD Waiver Wait List based on your original application date.
